By downloading, installing, or using NeroLens ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and NeroLens ("we," "us," or "our") governing your use of the App and any related services.
2. Description of Service
NeroLens is a mobile application that provides:
- AI-powered food recognition and nutritional analysis
- Calorie and macronutrient tracking
- Water and sugar intake monitoring
- Personalized AI fitness coaching through Nero
- Health statistics and progress tracking
- Customizable meal reminders and notifications
3. Subscription Terms
3.1 Free and Premium Features
NeroLens offers both free and premium subscription tiers. Premium features require an active subscription.
3.2 Subscription Billing
- Subscriptions are billed through Apple App Store or Google Play Store
- Payment will be charged to your App Store/Play Store account upon confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
3.3 Cancellation
You may cancel your subscription at any time through your App Store or Play Store account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for partial subscription periods.
3.4 Price Changes
We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle after the change takes effect.
4. User Responsibilities
4.1 Accurate Information
You agree to provide accurate information about yourself, including your age, weight, height, and health conditions. Inaccurate information may result in incorrect nutritional recommendations.
4.2 Appropriate Use
You agree not to:
- Use the App for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Upload inappropriate, offensive, or illegal content
- Interfere with or disrupt the App's functionality
- Share your subscription access with others
- Use automated systems to access the App
5. Health Disclaimer
Important: NeroLens is not a medical device and should not be used as a substitute for professional medical advice, diagnosis, or treatment.
- The nutritional information provided by AI analysis is an estimate and may not be 100% accurate
- Always consult with a healthcare professional before starting any diet or fitness program
- If you have any medical conditions, allergies, or dietary restrictions, consult your doctor before following any recommendations
- The AI coach (Nero) provides general fitness guidance, not medical advice
- We are not responsible for any health consequences resulting from following the App's suggestions
6. Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, images, audio, and software, are owned by NeroLens and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
7. Third-Party Services
The App integrates with third-party services:
- Google Gemini AI: Powers food recognition and the AI coach. Subject to Google's Terms of Service.
- Apple App Store / Google Play Store: Handles subscription payments and management.
We are not responsible for the availability, accuracy, or reliability of third-party services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- NeroLens is provided "as is" without warranties of any kind
- We do not guarantee the accuracy of nutritional information or AI recommendations
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid for the App in the past 12 months
9. Indemnification
You agree to indemnify and hold harmless NeroLens, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
10. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration.
